Nokia unlocking and the 3 network

The following is an "Un-Edited" email I received about 20 minutes ago. I have asked the permission of the sender to post it and have ensured anonymity.

Nokia 6280 unlocking
i rang up three uk for a unlocking solution and he guy said "that would be #200" so off course i payed like the stupid idiot i am and 2 weeks later three phoned up and said that they cant unlock it and that they weren't gonna give me my money

in conclusion if your thinking of getting a nokia 6280 or n70 dont get it on three

Our suggestion to anybody suffering the same fate is as follows:

1, Write a complaint to BBC Watchdog - www.bbc.co.uk/watchdog
2, Complain to Trading Standards www.tradingstandards.gov.uk/
3, File a small claim in your local Small Claims Court.

"Its theft", no ifs or buts "Its theft".

3 are making many enemies and need to be taken to task.

I work for 3 network and i disagree with what is written here, cause we unlock the handsets for our customers ,but only if the handsets belong to them or if it belongs to some one else then the other person can unlock the handset by paying a minimum amt of 15GBP, And the unlock code is provided in 7-15 working days and if the code does not work and the handset gets locked then we even refund the money,back into the credit card or we adjust it on their bill.

And also mind u that the contract needs to be completed and only then we charge 15 GBP or else we charge the remaining line rentals of the contract in advance which keep on getting adjusted on the bill.
Cheers.

To contextualise the following comments: i am a solicitor. I used to be head of legal in the International division of one of the other networks in the UK.

3's unlocking policy has been under scrutiny. check out

interestingly their revised terms mean that they MUST unlock your phone. they have the option of how they do this: either by code or by giving you an unlocked phone or whatever. But contrary to some posts in other forums, the inclusion of "may" in the sentence:
===
If you contact us to request that your Handset be unlocked from our network, we will arrange for your Handset to be unlocked in an authorised manner (which may include replacing your Handset with an unlocked Handset which is the sam e or similar specification to your Handset) and you must pay an unlocking administration charge (which will be shown in the Price Guide for 3 Services)
===
does not give them the right to refuse to change the handset if they can't unlock it remotely or in any other way. Put simply, in my opining, they have no choice but to unlock on demand. having to pay the monthly contract rate upfront seems a bit silly of Three but there is no real loss to the consumer other than a modicum of interest.
